Many Colorado businesses use commercial email as an important and often savvy part of their overall marketing strategies. While doing so is legal, it is important for businesses to be aware of the 2003 federal legislation referred to as the CAN-SPAM Act regarding their use.

Under the law, businesses are prohibited from engaging in any deceptive or misleading activity within their emails. This prohibition extends to all parts of it, including the from/to section, the subject line and within the body of the email itself. Covered businesses are not just those that engage in bulk emails, either. The provisions of the act apply to all businesses that use commercial emails, and violations may include penalties of up to $16,000 per email sent.
